Terms of Service

Version 2026-04-20. Effective 20 April 2026.

The short version. You need to be 18+ and the parent or legal guardian of any kid whose data you put in FamOwl. Be honest, don't abuse the app, respect your household members. We'll do our best to keep the app running, but we can't promise zero downtime or that the AI will always be right. Subscriptions auto-renew unless you cancel in Apple or Google's settings. New Zealand law governs these terms.

1. Accepting these terms

By creating a FamOwl account, ticking the consent box on sign-up, or continuing to use the app after a terms update, you agree to these Terms of Service and our Privacy Policy. If you don't agree, don't use FamOwl.

2. Who we are

FamOwl is operated by Simon Singh, a sole operator based in New Zealand. General support is at hello@famowl.app. Legal, privacy and terms questions: compliance@famowl.app.

3. Eligibility

Kids never create accounts themselves. Kid profiles exist only inside a parent's authenticated session.

4. Accounts and households

When you sign up, you create an account. Your account can create or join one household — a shared container for missions, rewards, kids, and the rest of the app's content. Households can have multiple parents (a primary and one or more co-parents) and multiple kids (up to the limit of your current subscription tier).

You are responsible for keeping your account credentials safe. Anything done under your account is treated as your action. If you think someone else has got access, email compliance@famowl.app and change your password immediately.

Kid profiles do not have independent credentials — a parent decides when to "switch to a kid profile" on a shared device. We offer an optional parent PIN to gate the switch-back from a kid profile to a parent profile; setting it is recommended.

5. Your kids, your responsibility

When you create a kid profile, you warrant that:

If you share custody, you confirm you have the other guardian's agreement (if required in your jurisdiction) to add the child to FamOwl. Disputes between co-parents are outside FamOwl's ability to mediate.

6. License to use FamOwl

Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download FamOwl on your devices and use it for personal, non-commercial household management. Your licence ends automatically if you terminate your account or breach these terms.

All intellectual property in the app — code, design, owl branding, copy — is owned by us. Your content (see section 8) remains yours.

You must not reverse-engineer, decompile, remove copyright notices, sell, sublicense, or use FamOwl to build a competing product.

We don't actively monitor your content, but we reserve the right to remove content or suspend accounts that obviously breach this section.

8. Content you put in FamOwl

Everything you enter — mission titles, reward descriptions, wish text, proof photos, AI prompts, kid display names, avatars — is your content. You keep ownership. You grant us a limited licence to store, process, and display that content as strictly necessary to provide the service to you and your household.

You represent and warrant that you have the rights to everything you upload, including any photos or images of children. Don't upload photos you don't have the right to use.

We may remove content that breaches section 7, that we're legally required to remove, or that a verified IP-rights holder has asked us to remove.

9. The AI assistant — know the limits

FamOwl's AI assistant is a convenience, not a parenting tool. It's powered by large language models routed via OpenRouter to Anthropic, Google, or OpenAI. It can be wrong, outdated, biased, or just weird.

10. Subscriptions and billing

Free tier

FamOwl's core features — unlimited missions, rewards, calendar, up to 3 kids, activity log — are free. You don't need a subscription to use the app.

FamOwl Premium

FamOwl Premium unlocks: unlimited kids, the AI assistant (beyond the free-tier 3/month sample), wishlist, daily challenge, long-term projects, and custom badge creation.

Pricing and plans

Prices shown in the app are the authoritative figures, displayed in your local currency by Apple or Google. Exchange rates and local tax may cause the actual amount charged to differ slightly.

Price changes

We may change the price of a subscription. If we do, we (or the App Store / Play Store on our behalf) will notify you at least 30 days before the change takes effect. If you don't agree to the new price, you can cancel before the next renewal.

Promotional entitlements

We occasionally grant free or discounted subscriptions (for example: goodwill comps, beta-tester passes, press or advocacy comps). These come with an expiry date we set at the time of grant. We can revoke a promotional entitlement at any time if we reasonably suspect abuse.

11. Changes to the service and these terms

We're actively developing FamOwl. That means we add, change, and sometimes remove features. We'll try not to break paid features without notice, but we reserve the right to modify the service at any time.

We may update these terms. If we change them materially, we'll notify you in-app with a re-consent prompt the next time you open the app, and via email where we have your address. The updated version's effective date is shown at the top of this page. Continued use after the effective date means you accept the new version; if you don't accept, your remedy is to stop using FamOwl and delete your account.

12. Termination

You, terminating your account

You can delete your account at any time from Settings → Legal & privacy → Delete my account. Deletion is immediate and permanent. If you're the sole parent in your household, your whole household (including kid profiles, missions, rewards, photos, activity, everything) is hard-deleted. If you share a household, your personal data is deleted and any content you authored is retained but scrubbed of authorship.

Cancelling a subscription does not delete your account; you can keep using the free tier. To stop using FamOwl entirely, delete your account and uninstall the app.

We may suspend or terminate your account at any time, with notice where practical, if:

FamOwl is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law. We don't warrant:

14. Limitation of liability

To the maximum extent permitted by law:

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law — including fraud, death or personal injury caused by our negligence, or statutory consumer-protection liabilities (see section 16).

You agree to indemnify and hold us harmless from any claim, liability, damage, or expense (including reasonable legal fees) arising out of:

We'll give you prompt written notice of any such claim and let you control the defence, provided you do so reasonably.

16. Consumer rights (NZ, AU, UK, EEA)

Nothing in these terms excludes, restricts, or modifies rights you have under mandatory consumer-protection laws, including:

If our service doesn't meet one of these statutory guarantees, you are entitled to the remedy the law provides — which may be a refund, replacement, or repair — and we'll honour that remedy.

17. Governing law and disputes

These terms are governed by the laws of New Zealand, without regard to its conflict-of-laws rules.

If we have a dispute, try to resolve it with us first by emailing compliance@famowl.app. Most things get fixed with a quick conversation.

If we can't, the courts of New Zealand have exclusive jurisdiction over disputes arising out of or related to these terms — except where applicable consumer-protection law gives you the right to bring proceedings in the courts of your country of residence, in which case you can do that.

There is no arbitration clause and no class-action waiver. You can act individually or as part of a group, as the law of your jurisdiction allows.
